Terms of Use for Businesses

These terms of use apply to businesses (“entrepreneur,” “business”) participating in the loyalty program provided by Loyella (“Loyella,” “we,” “company”). Acceptance of these terms is a prerequisite for using the loyalty program.

2. Description of the Service

Loyella provides a digital receipt-based loyalty program. Consumers collect receipts from purchases and upload them to the Loyella platform. Once a specific number of receipts is collected, the customer receives a reward provided by the business participating in the loyalty program.


3. Registration and Account Creation

Entrepreneurs must register with the Loyella service and create a business account. During registration, the entrepreneur must provide the necessary information, such as the business name, business ID, contact details, and other relevant data for using the service. The entrepreneur is responsible for ensuring the accuracy of the information provided.


4. Use of the Service and Obligations

Once registration is approved and the account is confirmed, the entrepreneur can participate in the Loyella loyalty program and offer rewards (e.g., free lunch or other benefits) to customers. The entrepreneur agrees to the following obligations:


5. Marketing and Visibility

Loyella provides marketing tools to help entrepreneurs promote the loyalty program. Entrepreneurs agree to promote the program through their own channels (e.g., websites and physical stores) to give customers the opportunity to participate.

Loyella may use the entrepreneur’s name and logo in marketing materials related to the loyalty program unless otherwise agreed.


6. Pricing and Fees

The service is free during the pilot phase; however, Loyella reserves the right to introduce paid additional services in the future. Entrepreneurs will be informed in advance of any changes or pricing updates.


7. Processing of Personal Data

Entrepreneurs agree to comply with data protection laws when handling customers’ personal data. Loyella processes the personal data of both entrepreneurs and customers in accordance with its privacy policy.


8. Intellectual Property Rights

All intellectual property rights related to the service, including software, branding, trademarks, and logos, belong to Loyella or its partners. Entrepreneurs may not use these rights for purposes other than the loyalty program without prior permission.


9. Limitation of Liability

Loyella provides the service “as is,” without explicit or implied warranties. Loyella is not liable for any indirect damages, such as loss of revenue or reputational harm, resulting from the use of the service.

Entrepreneurs are responsible for delivering agreed rewards to their customers and ensuring there are no delays or ambiguities. Loyella is not responsible for disputes between entrepreneurs and their customers.


10. Termination of the Service

Entrepreneurs may terminate their use of the service at any time by notifying Loyella in writing. Loyella reserves the right to terminate an entrepreneur’s access to the service if these terms are violated or the service is used unlawfully.


11. Changes to the Terms

Loyella reserves the right to modify these terms at any time. Significant changes will be communicated to entrepreneurs via email or through the service. By continuing to use the service after the changes, entrepreneurs accept the updated terms.


12. Governing Law and Dispute Resolution

These terms are governed by Finnish law. Any disputes arising from these terms or the service shall be resolved in the District Court of Helsinki, unless mandatory legislation specifies otherwise.
